The themes addressed by this paper intersect the industrial heritage and its main components, from industrial archeology to the technical landscapes of production. From this point of view, the historic center of São Luís, Brazil as case study has an intrinsic relationship with the Bacanga River. It is the main landscape that is to the surroundings of the historical center tilted by the Unesco. A Crítica de Hume ao Argumento do Desígnio José Oscar de Almeida Marques Dep. de Filosofia – UNICAMP -/- RESUMO: É comum considerar que o chamado “argumento do desígnio” (o argumento a posteriori para provar a existência de Deus a partir da ordem e funcionalidade do mundo) teria sido refutado ou seriamente abalado por Hume. Mas a natureza e o alcance dessa alegada refutação são problemáticos, pois Hume muitas vezes expressou suas críticas através de seus personagens e evitou assumi-las (...) diretamente enquanto autor. Em vez de supor que Hume procedeu dessa forma apenas para disfarçar suas verdadeiras convicções e evitar um conflito com as autoridades eclesiásticas, proponho que sua posição nesse assunto não é tão categórica como às vezes se supõe, e que os famosos argumentos de Filo nos Diálogos mostram apenas que é possível que a ordem e funcionalidade do mundo tenham surgido sem a intervenção de um desígnio consciente, mas não podem por si sós dar a essa hipótese o mínimo grau de plausibilidade necessário para torná-la digna de uma séria consideração. De fato, antes da revolução explicativa operada por Darwin um século depois, ninguém estava realmente em condições de vislumbrar uma alternativa plausível à atuação de algum tipo de inteligência na geração da ordem e funcionalidade do mundo. ------------ Some Remarks on Hume’s Critique of the Argument from Design José Oscar of Almeida Marques Dep. of Philosophy - UNICAMP -/- ABSTRACT: The so-called “argument from design” (the a posteriori argument to prove the existence of God from the order and functionality of the world) is commonly considered to have been refuted or seriously impaired by Hume. But the nature and scope of this alleged refutation is problematic because Hume often expressed his critics through other characters’ mouth and avoided to assume them directly as author. Contrarily to the supposition that Hume proceeded in this way only to disguise his true convictions and to avoid a confrontation with the ecclesiastical authorities, I propose that his stance on the matter is not, in fact, as clear-cut as it is sometimes supposed, and that Philo’s famous arguments in the Dialogues show only that it is possible for the order and functionality of the world to have arisen without the intervention of an intelligent design, but cannot by themselves lend to this hypothesis the least degree of plausibility needed to make it worthy of serious consideration. In fact, before the explanatory revolution inaugurated by Darwin a century later, nobody was in position to envisage a plausible alternative to the operation of some sort or other of intelligence in the generation of the order and functionality of the world. I examine the difficulties involved in the Aristotelian proposal to identify the knowledge of “what it is” and “why it is”, in order to better understand the outlines that delimit it. I propose that the connections by which Aristotle links definition and explanation, and hence essence and cause, depend on the mutual convertibility between nominal expressions and predicative sentences.

To try to understand Nietzsche’s conception of Christianity is to try to understand his conception of morality, or to try to analyze, dissect, and diagnose the forces and the relation of forces that underly it, or permeate it. These forces characterize not only the reality as Nietzsche considers it, but also the dynamic of his own writing, thought, and perspective. This is the reason why we can affirm that Nietzsche’s thought and writing are essentially, intrinsically, paradoxical. Indeed, the Nietzschean text (...) unfolds as what constantly resists and escapes the order of discourse as such, which means that it would be a frustrating undertaking to seek a key that discloses and explicates the plurality of meanings that engender and determine the development of his writing. Paradoxically, Nietzschean thought reveals itself only to the extent that it is masked, reread, repeated, rewritten, and stripped of all attempts to master it. In other words, it progresses through a continuous intermingling of forces and, consequently, of values, interpretations, and significations that are unceasingly overcoming and surpassing each other. This dissertation critically examines the writings of Max Stirner, especially his masterpiece The Ego and Its Own, as a discourse of resistance against modern forms of domination and, in particular, against the modern political State. I begin by examining Stirner's inversion of the Hegelian concept of the State, from the “actualization of freedom”to an instance of domination. The State appears, to Stirner as to Hegel, as the guardian of order and cohesion in modern societies. While both recognize the genesis of (...) sovereign power as violent, Hegel sustains that, with the progress of civilization, force is eradicated from the public order and private interests and common interest are reconciled. Stirner, on the contrary, insists that force is the other face of right, as the hidden pillar of the norm, which only reveals itself in moments of crisis. Stirner’s focus on the extreme case, largely anticipated and devalued by Hegel as unilateral and equivocal, seems to be anchored on the conviction that conflict is ineradicable, that between my own will and the (political, social) representation of that will there is always a gap, which cannot be filled by any collective arrangement. From this follows that, if conflict is scarcely manifest in modern societies, it is not because it was truly solved, but because it is effectively masked, due to the dissymmetry of power and the internalization of authority. The “unique one” appears, in this environment of great suspicion, as the one who cannot be represented, who surpasses every representation, threatening the authority of every representative. Accordingly, the “unique one” reclaims his own power, without allowing the satisfaction of his will to be mediated by obedience to collective institutions, affirming himself instead as sovereign over himself. Stirner suggests that the self-affirmation of the “unique one” inevitably leads to confrontation with the external powers that organize his existence. Stirner, nonetheless, chooses to think this confrontation in terms of a “revolt”, of a reflexive and individual act by which the individual emerges from the situation in which he finds himself, rather than as a “revolution”, a political or social act directed towards the systemic transformation of the status quo. Even if we admit the validity of the Stirnerian critique of the legitimizing discourses of modernity, the problem remains if this critique can be sustained on the “unique one”, “a thoughtless word”, an openly self-contradictory and self-destructive name, subject or principle (?). The possibility of founding a discourse of resistance on the egoism of Max Stirner seems to depend upon the answer that we choose to give to two intimately connected questions: what remains after the destructive vortex of the “unique one” that may sustain the resistance against a state that Max Stirner deems oppressive? Can this resistance be realized in the revolt of a unique one without the recognition of another one with whom to build the conditions of freedom? (shrink)

Despite pervasive variation in the content of laws, legal theorists and anthropologists have argued that laws share certain abstract features and even speculated that law may be a human universal. In the present report, we evaluate this thesis through an experiment administered in 11 different countries. Are there cross‐cultural principles of law? In a between‐subjects design, participants (N = 3,054) were asked whether there could be laws that violate certain procedural principles (e.g., laws applied retrospectively or unintelligible laws), and also (...) whether there are any such laws. Confirming our preregistered prediction, people reported that such laws cannot exist, but also (paradoxically) that there are such laws. These results document cross‐culturally and –linguistically robust beliefs about the concept of law which defy people's grasp of how legal systems function in practice. (shrink)

In his Lectures on Fine Art (1835), Hegel emphasizes the grotesque character of Indian art. Grotesqueness results, in his view, from a contradiction between meaning and shape due to the incongruous combination of spiritual and material elements. Since Hegel's history of art is teeming with examples of inadequacy between meaning and shape, this paper aims to distinguish the grotesque from other types of artistic dissonance and to problematize Hegel's ascriptions of grotesqueness to ancient Indian art. In the first part of (...) the paper, I characterize the grotesque by the unnatural distortion of natural shapes with the purpose of achieving a direct sensuous manifestation of an indeterminate and impersonal divinity, Brahman. Such an attempt is, in Hegel's view, self-contradictory and self-defeating, leading to an exaggeration of the conflict between nature and spirit instead of the intended reconciliation between the two parts. In the second part of the paper, I compare Hegel's account of Indian art to the ‘monstrous myths’ of early modern Europe. Unlike his predecessors, Hegel legitimizes the grotesque representations of Hindu gods as endowed with profound meaning and the result of a universal human need, yet he describes them as ultimately irrational and repulsive based on a prejudiced view of the Indian people(s). In this sense, Hegel's assessment of Indian art functions as a reflection of modern European culture, its fascination and horror in the face of what Enlightenment could not entirely purge, rather than as a truthful and objective account of Indian art and culture. By questioning Hegel's characterization of Hindu iconography and mythology, this paper contributes to underexplored areas of Hegelian aesthetics, namely Hegel's account of symbolic art, especially Indian art, as well as his views on negative aesthetic experiences and values. É comumente aceito, atualmente, que Aristóteles não teria enfrentado ou tentado seriamente resolver o famoso paradoxo do mentiroso, embora ele tenha sido formulado por Eubúlides de Mileto, membro da escola megárica e rival filosófico de Aristóteles. No máximo, assim reza a visão tradicional, ele parece apenas fazer uma menção desse paradoxo nas Refutações sofísticas, Capítulo 25, talvez esboçando a sua solução. O meu intento, no presente artigo, é desafiar essa opinião geral mostrando que o Estagirita fornece uma explicação implícita para (...) duas versões do paradoxo do mentiroso, a saber, a versão autorreferencial (que pode ser apresentada pela declaração: “esta declaração é falsa”), e a versão anafórica (que pode ser apresentada por meio de duas declarações mutuamente referentes como estas: “a próxima declaração é verdadeira” e “a declaração anterior é falsa”). A minha alegação é que a solução aristotélica para essas duas versões do paradoxo encontra-se no núcleo de sua refutação de duas teses, as quais denominei como tese da synalethia (que defende que toda declaração é verdadeira) e como tese da sympseudia (que defende que toda declaração é falsa). Tal refutação é realizada no oitavo capítulo do quarto Livro da Metafísica, um texto até agora subestimado pelos intérpretes modernos, mesmo sendo a parte final de um dos mais importantes escritos de Aristóteles. A solução aristotélica, assim defendo, é levada a cabo por meio dos seguintes princípios: (i) toda declaração é sempre precedida por um operador de verdade da forma ‘é verdade que...’, ou seja, toda declaração, qualquer que seja o que ela possa declarar a mais, primariamente assevera a sua própria verdade; e, em conformidade com o princípio anterior, (ii) toda declaração que assevera a sua própria falsidade ou acarreta a verdade de sua contraditória é necessariamente falsa. Através desses princípios, a refutação de Aristóteles da synalethia e da sympseudia é bem-sucedida. Mostrarei que obtemos uma boa solução para as versões do mentiroso acima mencionadas (e implicitamente presentes nas posições refutadas), apenas aplicando esses mesmos princípios a elas. Esse tipo de solução ao mentiroso tanto quanto para as teses antes citadas é muito parecido com aquele explicitamente encontrado nas obras de diversos filósofos, a saber, Guilherme de Sherwood, Tomás Bradwardine, João Buridano, Alberto da Saxônia, Paulo Venetus, Charles S. Peirce e Arthur Prior. Assim, também defendo que essa linhagem tem as suas raízes na solução de Aristóteles. (shrink)

Estas reflexões têm como principal objetivo mostrar como a concepção do belo em Agostinho de Hipona é tributária da tradição platônico-aristotélica e das Escrituras. No que tange à primeira influência, a ênfase é colocada nas noções de simetria, de proporção, de forma, de unidade e, portanto, de belo. No que diz respeito às Escrituras, Agostinho considera em primeiro lugar o papel da criação e a ação de Deus no universo como o Ser a partir do qual todas as coisas se (...) mantêm harmônica e proporcionalmente vinculadas entre si. Neste universo, ao pôr o acento sobre o homem como a imagem e semelhança de Deus, o teólogo explora igualmente o conceito de participação, que também remete a Platão e às Escrituras. O texto termina apontando para o paradoxo, tipicamente estoico, do apesar de, isto é, apesar do mal, existe o bem, apesar do feio e do desgracioso, existe o belo. (shrink)

Despite the importance of human blood to clinical practice and research, hematology and blood transfusion data remain scattered throughout a range of disparate sources. This lack of systematization concerning the use and definition of terms poses problems for physicians and biomedical professionals. We are introducing here the Blood Ontology, an ongoing initiative designed to serve as a controlled vocabulary for use in organizing information about blood. The notion of epistemic responsibility applied to memory has been in general examined in the framework of the responsibilities that a collective holds for past injustices, but it has never been the object of an analysis of its own. In this article, I propose to isolate and explore it in detail. For this purpose, I start by conceptualizing the epistemic responsibility applied to individual memories. I conclude that an epistemic responsible individual rememberer is a vigilant agent who knows when to (...) engage in different kinds of mental and non-mental actions in order to monitor and update her memories, and who develops and nurture different kinds of virtuous attitudes that guide those actions. These (epistemic) virtuous attitudes are oriented not only towards herself but also towards others. Whereas this conception of epistemic responsibility does not pose a problem to understand shared memories of family members and friends, it may seem suspicious when applied to large-scale collective memories. These memories, which I name historical memories, are memories of events that have a traumatic impact for the community, are permeated by unequal relations of power, keep a complex relationship with historical science, and present other characteristics that distinguish them from individual memories. But despite these differences, the analysis undertaken in this work shows that the general principles that govern the epistemic responsibility of individual and (large-scale) collective rememberers are similar, and are based on similar grounds: pragmatic considerations about the consequences of misremembering or forgetting and a feeling of care. The similarities at the individual and collective scale of the epistemic vigilant attitude that is and should be taken toward our significant past may partially justify the use of the same epithet—“memory”—to refer to these different kinds of representations. The Eleventh Aporia results from the breakup of the entire Greek philosophy previous to Aristotle in two manners of conceiving and proposing the first principles (archai), specially the One (to hen): (i) the manner by which Physiologoi conceived the One as a principle, namely, assuming an underlying nature, different from the One in itself, not adequately characterized by the simple fact of being one and which is denoted by the concept of One, and (ii) the manner inaugurated by the Pythagoreans (...) and later endorsed by Plato, marked by the abandonment of the appeal to an underlying nature and by conceiving the One in itself (auto to hen) as a principle, depriving it of any connection with some reality not strictly characterized by being one. Aristotle faces this aporia in Metaphysics Iota 2 and, according to the interpretation I propose: (a) refuses the Pythagorean-Platonic manner of conceiving and proposing principles, (b) endorses the course of action of the Physiologoi, and, in doing so, (c) steps back and retakes the “project” of the Physiologoi at the point where it was interrupted, namely, during the search for a principle of motion. From this scenario, I will try to show that the final outcome of the Eleventh Aporia can be the introduction of the Prime Mover as the properly Aristotelian (and cosmological) candidate to the title of One between the principles. Nadie sabe lo que quiere la Justicia porque la justicia no se deja escribir. Cuando digo escribir, digo instituir. La Justicia no se deja instituir. Con ello debe lidiar la actividad judicial, con el límite mismo, con la propia imposibilidad. Límite que exhibe oculto que hay algo allí que no hace cuerpo. Que hay algo que el orden de lo simbólico no logra apresar. Legendre decía: en occidente, instituir es escribir. Instituir a los hombres es ante todo, escribirlos, inscribirlos, ¿marcar (...) sus cuerpos? Kafka lo sabía bien. La democracia enfrenta también un desafío similar: asumir que el signo de lo ilimitado la acompaña en el regazo mismo que la dialéctica de la modernidad le ofrece. Los escritores, señala Milner, han descripto lo ilimitado para condenar sus consecuencias y sustraerse a ellas, como el caso de Rousseau, o para constatarlas y combatirlas mediante estrategias de inversión, de Baudelaire a Brecht.Arrasar con la diferencia es no soportar el límite, aquello que hace borde, aquello que no se deja decir. En otras palabras no aceptar la falta en el lenguaje. El presente trabajo pretende mostrar que es, precisamente, el punto de cruce que constituye el límite mismo, el lugar que aloja un encuentro posible entre justicia y democratización. El límite, lejos de clausurar, posibilita aquel enlace, lo augura. Es a nivel del lenguaje que esta relación requiere ser situada. Democratizar la lengua supone horizontalizarla, en otras palabras, abogar por la apertura y circulación del sentido. Son las teorías críticas del derecho las que aportan las herramientas necesarias para pensar esta articulación. Como señala Cárcova, es en el campo del sentido en donde el derecho adquiere su especificidad y produce los efectos que le son propios. Profundizar la democracia desde el campo jurídico exige, ante todo, democratizar al derecho mismo. (shrink)

We describe the rationale for an application ontology covering the domain of human body fluids that is designed to facilitate representation, reuse, sharing and integration of diagnostic, physiological, and biochemical data, We briefly review the Blood Ontology (BLO), Saliva Ontology (SALO) and Kidney and Urinary Pathway Ontology (KUPO) initiatives. We discuss the methods employed in each, and address the project of using them as starting point for a unified body fluids ontology resource. We conclude with a description of how the (...) body fluids ontology initiative may provide support to basic and translational science. (shrink)

Is the societal-level of analysis sufficient today to understand the values of those in the global workforce? Or are individual-level analyses more appropriate for assessing the influence of values on ethical behaviors across country workforces? Using multi-level analyses for a 48-society sample, we test the utility of both the societal-level and individual-level dimensions of collectivism and individualism values for predicting ethical behaviors of business professionals. Our values-based behavioral analysis indicates that values at the individual-level make a more significant contribution to (...) explaining variance in ethical behaviors than do values at the societal-level. Implicitly, our findings question the soundness of using societal-level values measures. Implications for international business research are discussed. (shrink)

I would extend Postman’s Technopoly to Technopolis, to give it more of a presence in time and space. Hence, I will use the term Technopoly when I am referring to Postman; the term Technopolis is my own. -/- In his book From Faith to Fun: The Secularisation of Humour, Russel Heddendorf argues that humour is a technology (Heddendorf 2009: 32-34), as it is understood and theorized by Neil Postman in Technopoly. Russel Heddendorf also argues that “Technopoly” is a term correlated with Wittgenstein’s use of the term “worldview” (Weltanschauung) (Heddendorf 2009: 11). -/- I would like to draw on these thoughts to propose that Technopoly (or Technopolis) could be the secularized Kingdom of God, namely that Technology is the Religion of the 21st century, and that Fun is a paradigm of such a Technology / Technique. God is yet another technique or Technology of and in Technopoly. -/- The godless individual in the 21st century, I will argue, is as much a believer as the faithful in the Sacred Religion (term used in opposition to Secular or rather Technological or Technologized Religion, which is Fun). He believes in Fun (as a post-modern form of pleasure), as much as the believer believes, or more accurately, believed in God. In the 21st century, the faithful in Sacred Religion believes in a fun God, as opposed to the serious God of the past. Fun is turning into the Technologized Religion for all; for the faithful in Godly / Sacred Religion, as well for as the unfaithful. Fun (pleasure, humour) is the definitive qualia of 21st century pleasure. The mechanics of Fun make it absolutely functional for controlling people; as Aldous Huxley wrote in Brave New World, people “are controlled by inflicting pleasure” (cited in Heddendorf 2009: 158). Now, indulging in pleasure is having Fun. In the 21st century, nobody is unfaithful, nobody disputes God, because God has been manufactured into Fun. We are living in the most religious century of all. -/- The commodity of God, now inextricably blended into work and leisure ethics and culture, is as unavoidable as survival. You don’t work, you don’t survive, you don’t exist. You work, you are entitled to leisure, or free time – the time (“busy-time”) when you are busy is work. The free time of leisure (“fun-time”) is a time for fun (pleasure). The time dedicated to Fun is culturally (capitalistically) pre-defined; no moment is actually free, each moment that is sold as free is to be bought with Work Time tokens –which is money. Believe is Enjoy. Happiness, achieved through pleasure, and pleasure through Fun, and Life as Play, is the recipe for Teleology in the 21st century. -/- The Technological God (Fun), as the Sacred God before him, is sovereignty’s technique or a social “mode of release”: demonstrations, marches, petitions, freedom of speech, citizen and human rights vindications, are “modes of release”, so that the next day, feeling relieved and released that you are working for a better life and a better world, you can wake up cheerfully to walk to your workplace, feeling it will change because of your marching, or your petition, or your speech, or the mass you attended, or the prayer you said yesterday. Thus life continues unchanging, through postponing hope; the tension of the tragedy is always released (lysis) in catharsis: refreshment for the next day of work. Art, especially cinema, (namely, simulated life) follows the same cathartic principles as real life. Thus, you can keep coping, and hoping in the meantime is of much help. Religion, Art, Science, Therapy, and Technology are all technologies used to market life, sell it or lend it, and humans are buying it back. Fun is free to produce, and expensive to buy. (shrink)

ISSN: 2036-6558 -/- --------- -/- The concept or the theory of Death in the thought of Jean Baudrillard is not given the particular attention (...) it needs. When one speaks of the thought of Baudrillard, one rarely will mention ‘death’ as one of the keywords of his corpus. I think, though, that it deserves such a key place, for three reasons. Firstly, because the theme of Death is a gargantuan concept in the history of Philosophy and it even emerges with the definition of Philosophy itself, since, at least, Plato. Every philosopher, more or less is preoccupied with it, as an archetypical necessity of both human culture and of philosophy in particular. It is always interesting to see how each philosopher or each person thinks on it, as their thoughts on Death are a departure point and an indication of their whole philosophical system or, for non-philosophers, of their whole way of life. Secondly, it is important to examine this theme in Baudrillard because it inseparably interconnects, explains, and is explained by all the other, key, and the less prominent themes in his philosophy. Baudrillard’s thinking might take new dimensions when viewed through his thoughts on Death. Finally, Baudrillard is considered a difficult thinker, because, unlike other philosophers, he grasps themes which people are used to seeing as the pre-occupation or within the realm of fiction, even science-fiction. I would like to show, using simple language, that his philosophy, especially surrounding the subject of Death, is completely naked of any metaphysical, romanticised, fantastic, or fiction-like properties; it is realistic and political. Memory is not a unitary phenomenon. Even among the group of long-term individual memory representations (known in the literature as declarative memory) there seems to be a distinction between two kinds of memory: memory of personally experienced events (episodic memory) and memory of facts or knowledge about the world (semantic memory). Although this distinction seems very intuitive, it is not so clear in which characteristic or set of interrelated characteristics lies the difference. In this article, I present the different criteria (...) proposed in the philosophical and scientific literature in order to account for this distinction: (1) the vehicle of representation; (2) the grammar of the verb “to remember”; (3) the cause of the memory; (4) the memory content; and (5) the phenomenology of memory representations. Whereas some criteria seem more plausible than others, I show that all of them are problematic and none of them really fulfill their aim. I then briefly outline a different criterion, the affective criterion, which seems a promising line of research to try to understand the grounds of this distinction. (shrink)

In Italien war die Rezeption von Jürgen Habermas über die Jahrzehnte konstant; bibliographischen Daten zufolge steht Italien nach Deutschland und den USA an dritter Stelle. Dennoch lautet unsere These, dass das Forschungsprogramm von Habermas in der italienischen scientific community marginal war – insofern ist im soziologischen Sinne Pierre Bourdieus eher von einem akademisch-wissenschaftlichen »Feld« zu sprechen, da es bezogen auf die Habermas-Rezeption keine Homogenität und Identität gibt.

El artículo se propone elucidar el papel que juegan los usos de “raza” en los escritos de Nietzsche, situándolos e interpretándolos en conjunto con el léxico de transformación del ser humano y de su crítica de la cultura. Para ello, se estudia su empleo junto a otros conceptos fronterizos e ideas análogas como el tratamiento de la cuestión judía, su crítica del nacionalismo, la figura de los buenos europeos, la metáfora de la bestia rubia, los tipos humanos y el pensamiento (...) de la cría. Se concluye que “raza” posee un indudable carácter fisiológico y evolutivo, pero a través del proceso de incorporación (Einverleibung), el ámbito de la cultura y la moral intervienen de manera fundamental en su conformación, y como concepto, forma parte del mismo proyecto de transvaloración de los valores, la reforma de la cultura y de la humanidad. El artículo finaliza con una reflexión de la llamada a superar la raza (Über-Rasse). (shrink)

El artículo intenta recuperar la figura de Dora Benjamin como referente de la crítica social, reconstruyendo las huellas de aquello que el silencio de su imagen posibilita interpretar.

Higginbotham argued that certain linguistic items of English, when used in indirect discourse, necessarily trigger first-personal interpretations. They are: the emphatic reflexive pronoun and the controlled understood subject, represented as PRO. PRO is special, in this respect, due to its imposing obligatory control effects between the main clause and its subordinates ). Folescu & Higginbotham, in addition, argued that in Romanian, a language whose grammar doesn’t assign a prominent role to PRO, de se triggers are correlated with the subjunctive mood (...) of certain verbs. That paper, however, didn’t account for the grammatical diversity of the reports that display immunity to error through misidentification in Romanian: some of these reports are expressed by using de se triggers; others are not. Their IEM, moreover, is not systematically lexically controlled by the verbs, via their theta-roles; it is, rather, determined by the meaning of the verbs in question. Given the data from Romanian, I will argue, the phenomenon of IEM cannot be fully explained starting either from the syntactical or the lexical structure of a language. (shrink)

La investigación reciente en psicología cognitiva sobre la memoria emocional ha estudiado las distintas formas en que las emociones afectan a la memoria, sin profundizar no obstante en la comprensión de la manera en que los aspectos emocionales, afectivos y mnemónicos se encuentran estrechamente entrelazados en el contenido mismo de un acto de reminiscencia. En este artículo propongo un marco conceptual de análisis que nos permite entender los recuerdos personales como recuerdos esencialmente afectivos, y que se articula en torno a (...) dos variables continuas e independientes: por un lado, la intencionalidad del recuerdo, es decir, el objeto hacia el cual el recuerdo está dirigido, que puede ser descriptiva o evaluativa; por el otro, la perspectiva afectiva del recuerdo, que puede fluctuar desde la perspectiva de primera persona hasta la perspectiva de tercera persona. Las dos dimensiones son analizadas en profundidad y las limitaciones de este marco y las futuras líneas de investigación son igualmente presentadas. (shrink)

This paper analyses the arguments for and against what we have called automatic organ procurement model in relation to the organs of the deceased. For this purpose, this work provides empirical evidence to assess the potential impact of this model on donation rates and on public opinion. Specifically, we examine first the reasons supporting this model, with special reference to utilitarian and justice arguments. On the other hand, we analyse both the approaches based on the violation of pre mortem and (...) post mortem interests opposing this theoretical model and the rejection the model would generate in the population. Finally, we point out the aspects that, in our opinion, should be exhaustively regulated if this model were implemented. In particular, we refer to the legal status of the human body, the treatments for end-of-life patients, the incentives for health professionals and the recognition of the right to conscientious objection. ¿Qué relación hay entre derecho y lenguaje? Y ¿entre lenguaje y ley? ¿Cómo se inicia la serie de la juridicidad? ¿Qué la posibilita? Una característica hace de lo humano algo aparte de lo vivo: la palabra. El presente trabajo pretende recorrer parte de esta huella, intentando repensar allí la centralidad del lenguaje en la estructuración misma de la juridicidad. Volverse al lenguaje es, en definitiva –como señala P. Sneh– un gesto político.

La metáfora de la memoria como “viaje mental en el tiempo” (“mental time travel” en inglés) ha tenido una gran influencia en la ciencia cognitiva de la memoria así como también en la filosofía de la memoria contemporánea. A pesar de su relevancia, no ha habido ninguna discusión teórica real ni sobre el significado de la metáfora en sí misma ni sobre su adecuación para dar cuenta de los recuerdos de experiencias pasadas. Este artículo trata de llenar este vacío al (...) examinar con más detalle la metáfora del “viaje mental en el tiempo”, centrándose más específicamente en los problemas que dicha noción presenta. Si la metáfora del “viaje mental en el tiempo” pretende referir no solo a una facultad o sistema cerebral sino también a una experiencia subjetiva particular, como así ha sido sugerido en la literatura, no es de por sí evidente que sea compatible con las nociones de (re)construcción y simulación con las que se la asocia frecuentemente, ni que describa de manera fehaciente la fenomenología de todo recuerdo del pasado personal. Si, por el contrario, sólo se refiere a una facultad o sistema cerebral y no pretende dar cuenta de la fenomenología del recuerdo, el uso de dicho término parece perder todo sentido para nombrar dicha facultad. A pesar de su relevancia, la metáfora del “viaje mental en el tiempo” no se ha impuesto como paradigma único: otras metáforas distintas continúan guiando actualmente programas más o menos fructíferos de investigación de la memoria. El artículo concluye que aunque dicha metáfora fue beneficiosa en su momento para la ciencia y la filosofía de la memoria, el examen minucioso de dicha noción sugiere que no constituye realmente una buena metáfora de la memoria sobre las experiencias pasadas, por lo que debería ser abandonada. El trabajo somete a discusión algunos elementos y argumentos del ensayo "Anti-Nietzsche. La crueldad de lo político" de Jorge Polo Blanco. Analizo el libro de Polo considerando el problema de la diversidad de caracterizaciones parciales que obtiene la figura de Nietzsche en el pensamiento filosófico contemporáneo y el desafío que supone actualizar a Nietzsche a la luz de nuestras sensibilidades democráticas. Examino los capítulos del libro apuntando algunas de las incorrecciones y aspectos más dudosos de su argumentario “anti-nietzscheano” e incidiendo (...) en la importancia del estudio de fuentes (Quellenforschung) y de la historia de las ediciones de la obra de Nietzsche para una interpretación filosófica rigurosa. La crueldad de lo político. I analyze Polo’s book while considering the problem of the diversity of characterizations that Nietzsche receives in contemporary philosophical thought and the challenge of evaluating his philosophy in light of our democratic sensibilities. I examine the different chapters and identify some of the inaccuracies and most dubious aspects of Polo’s “anti-Nietzschean” argument. In doing so, I stress the importance of source research (Quellenforschung) and the history of the editions for rigorous philosophical analyses. Théodule Ribot est l’un des premiers à penser les rapports entre mémoire et émotions. Au sein de ce qu’il appelle la « mémoire affective », il décèle une mémoire spécifique des émotions. Il s’ensuit un débat sur l’existence, la définition et le contenu de cette mémoire. Après les propositions initiales de Ribot, on observe l’émergence progressive d’un consensus : même s’il est possible de distinguer la mémoire affective de la mémoire intellectuelle, tout souvenir présente à des degrés variables des éléments (...) intellectuels et des éléments affectifs. Si, dans le cadre académique, ces débats sont tombés dans l’oubli, on peut établir une continuité conceptuelle avec la recherche scientifique actuelle, qui gagnerait à relire cette littérature centenaire. The aim of this paper is to relate the critical core of Jesus Conill’s last book, Bodily Intimacy and the Human Person. From Nietzsche to Ortega and Zubiri, with the problem of nihilism, as a structure that survives in our contemporary societies, especially in the context of neurosciences, technology and our way of relating to both. After outlining the key insights of the book, especially its innovative conception of bodily intimacy, I will retrieve some contributions from Nietzsche’s notes regarding nihilism, (...) to show that after the “death of God”, other instances take his place, the logics of nihilism remain intact and underly the majority approach of neurosciences. I will conclude that the elements presented by Conill for a strong intimacy and subjectivity will be necessary for the task, still pending, of overcoming nihilism. (shrink)

En “The King´s two bodies” Kantorowicz explora la ficción legal de los dos cuerpos del Rey: cuerpo mortal y cuerpo político. Ficción en la cual el rey, constituido como persona ficta, trasciende la temporalidad de cualquier cuerpo individual sobre la idea de “dignitas non moritur”. El presente trabajo pretende abordar la lectura de esa dualidad corporal encarnada en el derecho a través de un doble registro: cuerpo textual y cuerpo imaginario, explorando asimismo cómo el discurso jurídico se construye en el (...) marco de dicha simbología y legitimidad. Instituir lo vivo del texto jurídico no puede hacerse más que sobre el rastro de la semiótica misma. Como señala Legendre, la normatividad produce un “Écrit vivant” en perpetua necesidad de interpretación. Es paradójicamente la batalla por la apertura del texto lo que permite la imagen misma de su continuidad. Una crítica de los montajes vividos, de la instancia de la censura que ata y moviliza el discurso jurídico, provee el fondo de una urgencia: el de la tarea iusfilosófica por venir. (shrink)
